TrustWall — Terms of Service
Effective date: July 18, 2026
These Terms of Service ("Terms") govern your access to and use of TrustWall, the reputation and testimonial service made available at trustwall.the-atlas-project.net ("the Service"), operated by The Atlas Project ("we," "us," "our," "Provider"), part of the "An Atlas Project" family of products.
Please read these Terms and our Privacy Policy, which is incorporated by reference. The Privacy Policy explains what data the Service collects and processes. Where a term below conflicts with the TrustWall Product Rider (§20), the Rider controls for this product.
§0 Definitions
- "We," "us," "our," "Provider" — The Atlas Project, operator of the Atlas Project portfolio and of TrustWall.
- "Service" — the TrustWall software-as-a-service at trustwall.the-atlas-project.net, including its website, application, hosted proof pages, embeds, badges, collection links, APIs, and related documentation.
- "You," "your," "Customer," "Provider-Customer" — the individual or business that registers for or uses the Service. If you use the Service on behalf of an organization, "you" means that organization, and you represent that you are authorized to bind it. (Where needed for clarity, "Provider-Customer" is used to distinguish you — the business showcasing testimonials — from us.)
- "Account" — your registered access credential and workspace for the Service.
- "Subscription" — a paid plan (Pro or Studio) granting access to the Service for a recurring term. "Free" is the default, no-charge entitlement.
- "Order" — your selection of a plan at signup or checkout, together with these Terms.
- "Proof Page" — a hosted page the Service assembles and serves at a TrustWall URL (or, on paid tiers, your custom domain), displaying reviews and testimonials associated with a business.
- "Testimonial Content" — reviews, ratings, quotes, names, titles, photos, logos, and other materials that (a) you submit or upload, (b) your clients submit to you through a TrustWall collection link, or (c) the Service assembles from public or third-party sources on your instruction.
- "Your Content" — Testimonial Content and any other data, files, text, or materials you submit to, upload to, or generate within the Service, or that the Service accesses on your instruction.
- "Third-Party Services" — services not operated by us that the Service relies on or that you connect (e.g., Stripe, Supabase, Vercel, Resend, and the public-review/SERP retrieval provider described in the Privacy Policy).
- "Output" — proof pages, assembled review sets, embeds, badges, and other materials the Service produces from Your Content or from public/third-party data.
- "Terms" — these Terms of Service, together with the TrustWall Product Rider (§20) and any Order.
§1 Acceptance of Terms
By clicking "Create account," "Sign up," "Subscribe," "Claim this page," "I agree," or a similar control, or by accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not create an account or use the Service.
You represent that you are at least 18 years old and, if acting for an organization, that you have authority to bind it. These Terms form a binding agreement between you and The Atlas Project. We may present a summary of these Terms for convenience, but the full text governs.
§2 The Service; Accounts; Eligibility
2.1 What the Service does. TrustWall lets a business assemble scattered public reviews and directly-collected client testimonials into a hosted Proof Page, and to embed that proof (as an embed or a badge) on its own website, proposals, or profiles. You can create a Proof Page for free; paid tiers remove the TrustWall badge, enable a custom domain, and unlock import/export and (on Studio) white-label output, an API, and multiple client workspaces.
2.2 Account registration. You must provide accurate, current registration information and keep it up to date. You are responsible for all activity under your Account and for maintaining the confidentiality of your credentials. Notify us promptly at admin@the-atlas-project.net of any unauthorized use.
2.3 Authentication. The Service uses Supabase for authentication. You may sign in by email magic link or with Google sign-in. You are responsible for safeguarding any magic link or OAuth session associated with your Account.
2.4 Eligibility. The Service is intended for business and professional use by users who are at least 18. It is not directed to children (see §16). You may not use the Service if you are barred under applicable law or sanctions (see §17).
2.5 One account per user/entity unless we agree otherwise in writing. You may not share credentials. Agencies may operate multiple client workspaces where the Studio tier expressly permits (see §3).
2.6 Changes to the Service. We may add, modify, or discontinue features. We will use reasonable efforts to give notice of material adverse changes to paid features. Continued use after a change constitutes acceptance.
§3 Subscriptions, Billing, Fees, and Refunds
3.1 Plans and prices. TrustWall is flat-rate. We do not charge a percentage of, or a performance fee on, any business you close, deposit you take, or revenue you earn through your Proof Page. The plans are:
| Plan | Price | What you get |
|---|---|---|
| Free | $0 | Hosted Proof Page at a TrustWall URL; one workspace; the "Collected with TrustWall" badge is shown on your page, embed, and badge artifacts. |
| Pro | $19 / month or $190 / year (annual = 2 months free) | Everything in Free, plus: the TrustWall badge is turned off; point the Proof Page at your own custom domain; import/export reviews; native embed blocks; one workspace. |
| Studio | $39 / month or $390 / year (annual = 2 months free) | Everything in Pro, plus: white-label output; API access; analytics; up to five client workspaces. |
Prices are in US dollars and are shown at checkout. "Claiming" a Proof Page means subscribing to a paid plan (Pro by default); the paid entitlement — for example, removing the badge — applies while your Subscription is active.
3.2 Payment processor. All payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the fees associated with your plan, and you agree to Stripe's applicable terms. We do not store full card numbers; card data is handled by Stripe.
3.3 Auto-renewal. Paid plans are offered on a monthly or annual recurring basis, as shown at checkout. Unless otherwise stated, subscriptions automatically renew at the end of each billing period at the then-current rate until cancelled.
3.4 Free tier. The Free tier may have usage limits and may change or end at our discretion. We will not begin charging a paid rate without your having selected a paid plan.
3.5 Price changes. We may change prices. For recurring subscriptions, we will give at least 30 days' notice before a price change takes effect for your next renewal, by email to your Account address or in-product notice. If you do not agree, you may cancel before the change takes effect.
3.6 Cancellation. You may cancel at any time from your Account settings or the Stripe billing portal, or by emailing admin@the-atlas-project.net. Cancellation takes effect at the end of the current billing period. You retain paid access until then; after that, your Account falls back to the Free entitlement (for example, the TrustWall badge returns to your Proof Page, embed, and badge artifacts, and paid-only features such as the custom domain are disabled).
3.7 Refunds. Except where required by applicable law, fees are non-refundable, and we do not provide prorated refunds for partial periods, unused time, or downgrades. If mandatory local consumer law grants you a refund or withdrawal right, we honor it to the extent required.
3.8 Taxes. Fees are exclusive of taxes. You are responsible for any sales, use, VAT, GST, or similar taxes, excluding taxes on our net income. Where we are required to collect tax, it will be added at checkout.
3.9 Failed payments; past-due accounts. If a charge fails, we (via Stripe) may retry. We may suspend or downgrade your Account to the Free entitlement for non-payment after reasonable notice.
3.10 Chargebacks. If you dispute a charge with your bank rather than contacting us first, we may suspend your Account pending resolution. Please contact admin@the-atlas-project.net before initiating a chargeback.
§4 Acceptable Use Policy
You agree not to, and not to permit any third party to:
- Use the Service in violation of any law, regulation, or third party's rights.
- Reverse engineer, decompile, or attempt to derive source code, except to the extent this restriction is prohibited by law.
- Resell, sublicense, or provide the Service to third parties except as expressly allowed (for example, an agency operating client workspaces on Studio, using Output for its own and its clients' proof pages).
- Circumvent usage limits, rate limits, entitlement gates, or access controls; probe, scan, or test the vulnerability of the Service without authorization. In particular, you may not attempt to remove, hide, alter, or spoof the "Collected with TrustWall" badge or any sample/illustrative label except by holding the paid entitlement that turns the badge off (see §20.6).
- Upload malware, or content that is unlawful, infringing, defamatory, or that you lack the rights to submit.
- Submit, assemble, or display fabricated, fake, or deceptive reviews or testimonials, or reviews you know to be false, or reviews that misrepresent the reviewer's identity or experience (see the FTC and endorsement provisions in §20.2).
- Use automated means to extract data from the Service beyond features we provide, or to build a competing dataset or product.
- Misrepresent Output as something it is not — for example, presenting an assembled or sample Proof Page as a set of independently verified facts about a business, or presenting illustrative/sample content as genuine customer testimonials.
- Interfere with or disrupt the integrity or performance of the Service or the data it contains.
We may investigate suspected violations and may suspend or terminate access for conduct we reasonably believe violates this section or creates risk or legal exposure.
§5 Your Content; Licenses; Responsibility
5.1 Ownership. As between you and us, you retain all rights in Your Content, including Testimonial Content you submit or collect. We claim no ownership of it.
5.2 License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, store, process, transmit, format, and display Your Content — including on hosted Proof Pages, in embeds, in badges, and in the collection flow — and to serve it to sites where you place a TrustWall embed or badge, solely to provide, maintain, secure, and improve the Service for you, and as needed to route it to the Third-Party Services and subprocessors you have enabled. This license ends when Your Content is deleted, except for residual backups purged on our ordinary cycle and records we must retain by law. (Because Proof Pages, embeds, and badges are meant to be published, deletion may take time to propagate to cached or third-party-hosted copies you have placed.)
5.3 Your representations. You represent that you have all rights and consents necessary to submit, collect, and publish Your Content and to have us display and process it as described, and that Your Content and your use of Output do not violate law or third-party rights. Testimonial-specific representations are set out in §20.2.
5.4 No sensitive-data categories. You agree not to submit special-category data (e.g., health, biometric, government-ID, or payment-card numbers) into testimonials or free-text fields. Testimonials should contain only the reviewer's ordinary identifying details (such as name, role, company, and photo) and their opinion.
5.5 Feedback. If you send us suggestions, we may use them without restriction or obligation to you.
§6 Intellectual Property; Our Rights; Third-Party Marks
6.1 Our IP. The Service, including its software, design, text, and the Atlas Project and TrustWall names and logos, is owned by us or our licensors and protected by IP laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
6.2 License to you. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes for the term of your Subscription, including the right to display Output you generate (your Proof Page, embed, and badge) on your own or your clients' web properties, subject to §20.5.
6.3 Third-party trademarks / nominative use. TrustWall references third-party platforms and directories by name — for example, Google, Upwork, and other sites where a business's public reviews appear — to identify the source of assembled reviews. Those names are the trademarks of their respective owners and are used only for nominative identification. We are not affiliated with, endorsed by, or sponsored by those platforms.
§7 Third-Party Services and Data
7.1 Connections and reliance. The Service relies on Third-Party Services (e.g., Stripe for payments, Supabase and Vercel for infrastructure, Resend for email, and a public-review/SERP retrieval provider for the scan). Your use of any service you connect is governed by its own terms and privacy policies.
7.2 Public and third-party review data. When you run a scan, the Service retrieves and assembles public or third-party review data (for example, reviews visible on Google, Upwork, or the open web) associated with a business. That data is provided by third parties, may be subject to their terms and display/attribution requirements, and may be incomplete, out of date, or inaccurate. You are responsible for ensuring that your display and republication of assembled reviews complies with the applicable source platform's terms and with law (including attribution rules and restrictions on scraping or bulk reuse). See §20.3.
7.3 No control over third parties. We are not responsible for the availability, accuracy, or acts of Third-Party Services, and their failure or change may affect the Service.
§8 Accuracy Disclaimer (Output)
The Service produces Output — Proof Pages, assembled review sets, embeds, and badges — using software, public data, and third-party data. Output is provided for informational and promotional purposes and may be incomplete, out of date, or incorrect. An assembled Proof Page reflects reviews and testimonials as retrieved or submitted at a point in time; it is not an independent verification of any business's quality, conduct, or claims, and it is not professional advice of any kind. You are responsible for reviewing, approving, and deciding whether and how to publish and rely on Output. Product-specific accuracy and endorsement statements in §20 control for this product.
§9 Warranty Disclaimer
THE SERVICE, OUTPUT, AND ALL RELATED MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, THAT ANY SCAN WILL FIND OR ASSEMBLE ANY PARTICULAR REVIEW, OR THAT OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE. WE DO NOT WARRANT ANY PARTICULAR RESULT, INCLUDING ANY AMOUNT OF LEADS, CONVERSIONS, BOOKINGS, OR REVENUE OBTAINED FROM YOUR PROOF PAGE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
§10 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
10.1 Exclusion of certain damages. NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
10.2 Cap. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE TOTAL FEES YOU ACTUALLY PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (b) ONE HUNDRED U.S. DOLLARS ($100).
10.3 Application. THESE LIMITS APPLY TO ALL THEORIES OF LIABILITY (CONTRACT, TORT, STATUTE, OR OTHERWISE) AND ARE AN ESSENTIAL BASIS OF THE BARGAIN. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the least extent permitted.
10.4 Third-party and content outcomes. We are not liable for the acts, omissions, or decisions of any Third-Party Service, of the platforms whose public reviews are assembled, or of your own clients or reviewers. We are not liable for claims arising from the content of testimonials or reviews you submit, collect, assemble, or display, or from your placement of a TrustWall embed or badge on a third-party site (see §20.5).
§11 Indemnification
You will defend, indemnify, and hold harmless The Atlas Project and its owners, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content, including any testimonial or review you submit, collect, assemble, publish, or embed; (b) your use of the Service or Output, including your republication of reviews or your display of a Proof Page, embed, or badge; (c) your violation of these Terms, applicable law, or third-party rights (including the FTC Act and rules on endorsements and consumer reviews, defamation, privacy and publicity rights, intellectual-property rights, and the terms of any source platform); (d) any claim that a testimonial is fabricated, deceptive, non-consensual, or misattributed; and (e) your relationships and transactions with your clients, reviewers, or counterparties. We may assume the exclusive defense of any matter subject to indemnification, at your expense, and you will cooperate.
§12 Term; Suspension; Termination
12.1 Term. These Terms apply while you have an Account or use the Service.
12.2 Termination by you. You may terminate by cancelling and closing your Account. §3.6–3.7 (cancellation/refunds) apply.
12.3 Suspension/termination by us. We may suspend or terminate your access, with or without notice, for (a) breach of these Terms or the Acceptable Use Policy, (b) non-payment, (c) legal or security risk, (d) a substantiated claim that your Testimonial Content is fabricated, infringing, or unlawful, or (e) conduct that may harm us, other users, or third parties. Where practical and lawful, we will give notice.
12.4 Effect. On termination, your license to use the Service ends, and we will unpublish or disable your hosted Proof Pages, embeds, and badges served by us. We will make Your Content available for export for a limited period where feasible, then delete or de-identify it on our ordinary cycle, except records we must retain by law. Copies you have placed or cached on third-party sites are your responsibility to remove.
12.5 Survival. Sections that by their nature should survive (e.g., §§3.7–3.8, 5–6, 8–11, 13–19, and §20's representation, indemnity, and labeling provisions) survive termination.
§13 Modifications to These Terms
We may update these Terms. If we make a material change, we will provide notice by email to your Account address or by a conspicuous in-product notice at least 15 days before it takes effect (or as required by law), and we will update the "Last updated" date. Non-material changes take effect when posted. Your continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and may cancel under §3.6.
§14 Governing Law and Venue
14.1 Governing law. These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
14.2 Venue. Subject to §15, the state and federal courts located in New York have exclusive jurisdiction, and each party consents to personal jurisdiction and venue there.
§15 Dispute Resolution
15.1 Informal resolution first. Before filing any claim, you agree to contact us at admin@the-atlas-project.net and attempt in good faith to resolve the dispute for at least 30 days.
15.2 Courts (this product ships with Option B). Any dispute will be resolved exclusively in the state or federal courts located in New York, as set out in §14.2, and each party waives any objection to that venue. Each party waives any right to a jury trial to the extent permitted by law.
§16 Children
The Service is not directed to individuals under 18, and we do not knowingly collect personal information from them. If you believe a minor has provided us personal information, contact admin@the-atlas-project.net and we will delete it.
§17 Export, Sanctions, and Trade Compliance
You represent that you are not located in, and are not a resident or national of, any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government restricted-party list. You will not use the Service in violation of U.S. export-control or sanctions laws. We may block or terminate access to comply.
§18 Notices; Assignment; Force Majeure; Miscellaneous
18.1 Notices to you may be sent to your Account email or posted in-product. Notices to us go to admin@the-atlas-project.net. 18.2 Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. 18.3 Force majeure. Neither party is liable for delay or failure due to causes beyond reasonable control. 18.4 No waiver. A failure to enforce is not a waiver. 18.5 Relationship. The parties are independent contractors; these Terms create no agency, partnership, or joint venture. 18.6 No third-party beneficiaries, except indemnified parties under §11.
§19 Severability; Entire Agreement
If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains in effect. These Terms, together with the Privacy Policy, the TrustWall Product Rider (§20), and your Order, are the entire agreement between you and us regarding the Service and supersede prior agreements on the subject.
§20 TrustWall Product Rider
This Rider adds product-specific terms for TrustWall. Where it conflicts with §§1–19, this Rider controls for TrustWall.
20.1 Nature of the Service. TrustWall assembles two kinds of proof: (a) public or third-party reviews the Service retrieves on your instruction (e.g., from Google, Upwork, or the open web), and (b) testimonials submitted directly to you by your clients through a TrustWall collection link, or that you upload yourself. Both are displayed on your hosted Proof Page and in your embeds and badges. You are the party publishing this proof; we host and format it at your direction.
20.2 Testimonials — genuineness, consent, and FTC compliance. You are responsible for the truthfulness and lawfulness of every testimonial and review you submit, collect, or display. You represent and warrant, for all Testimonial Content, that:
- (a) it reflects the genuine, honest experience and opinion of a real person or business who actually used your product or service;
- (b) you have obtained all consents and permissions necessary to collect, publish, and display it — including the reviewer's name, title, company, likeness, photo, and quote — and to have us host and serve it;
- (c) it is not fabricated, fake, AI-generated as if from a real customer, purchased, or misattributed, and does not misrepresent the reviewer's identity, experience, or connection to you;
- (d) where a review was incentivized (for example, given in exchange for a discount, gift, payment, or other benefit), that material connection is disclosed as required by law; and
- (e) it complies with the FTC Act, the FTC's rules and guidance on endorsements, testimonials, and the use of consumer reviews (including the prohibition on fake or deceptive reviews and on suppressing honest negative reviews), and with any applicable state consumer-protection law.
You will not use the Service to create, buy, sell, or display fake reviews, to review your own business as if you were a customer, or to suppress or selectively hide genuine reviews in a way that is deceptive. You — not us — are the endorser's counterparty and the party responsible for the endorsement.
20.3 Public-review assembly. Public reviews the Service retrieves are third-party data. You acknowledge that (a) they may be incomplete, out of date, or inaccurate; (b) their display and reuse may be governed by the source platform's terms, including attribution and display requirements; and (c) you are responsible for ensuring your use complies with those terms and with law. Assembled reviews are automated, point-in-time retrievals, not an independent verification of any business, and you may not present them as such.
20.4 License to host, display, and embed. For Testimonial Content and Output, you grant us the license in §5.2 specifically so we can host your Proof Page, render your embeds and badges, and serve them to the sites where you place them. Because these artifacts are published and may be embedded on other sites, removal or deletion may take time to propagate, and we are not responsible for cached or third-party-hosted copies you have placed.
20.5 Embeds on third-party sites are your responsibility. When you place a TrustWall embed or badge on your own or a client's website, proposal, profile, or other property, you are responsible for that placement, for having the right to place it there, and for the content displayed. Our embed and badge artifacts use signed tokens and a domain allowlist; you are responsible for configuring the allowed domains and for the sites on which you display them.
20.6 The "Collected with TrustWall" badge; entitlement gating. On the Free tier, your Proof Page, embed, and badge display a "Collected with TrustWall" badge. Whether the badge shows is controlled server-side by your live subscription entitlement — not by the markup on your site. Turning the badge off is a genuine feature of the Pro and Studio tiers, not a setting you may hack, spoof, or circumvent. Attempting to remove, hide, or fake the badge without the paid entitlement is a breach of §4.
20.7 Sample and illustrative content stays labeled. The Service and its marketing pages display sample, demo, or illustrative testimonials and walls that are clearly labeled as such in-product. You may not strip, hide, or alter those labels, or present sample/illustrative content as genuine customer testimonials. If the Service serves you demo data (for example, before you connect live sources), it is labeled, and it must stay labeled wherever it appears.
20.8 DMCA and takedown; designated agent. We respect intellectual-property rights and respond to valid notices of claimed infringement under the Digital Millennium Copyright Act (DMCA) and comparable laws.
- To submit a notice, send a written notice to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to locate it (e.g., the Proof Page URL); (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law; and (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the rights holder's behalf.
- Designated DMCA agent: [DMCA_AGENT_NAME], The Atlas Project — admin@the-atlas-project.net — [DMCA_AGENT_MAILING_ADDRESS].
- Counter-notice and repeat infringers. A person whose content was removed may submit a counter-notice with the elements required by the DMCA. We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
- We may remove or disable access to content claimed to be infringing without prior notice, and we are not liable for doing so in good faith.
20.9 Impersonation prohibited. You may not create a Proof Page for, claim, or display testimonials on behalf of a business you do not own or are not authorized to represent, and you may not impersonate any person or business or misrepresent your affiliation with one. We may remove pages and suspend accounts we reasonably believe involve impersonation.
20.10 Reviewer and takedown requests. A person featured in a testimonial or review may ask that it be corrected or removed by contacting admin@the-atlas-project.net. Because you control the content on your Proof Page, we may route such requests to you as the publisher and/or act on them where required by law or our policies.
